These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Engineer Exams ("Company," "we," "us," or "our") governing your access to and use of engineerexams.com and all related international domains (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
Important: These Terms contain an arbitration clause and class action waiver that affect your legal rights (Section 16).
2. Eligibility
You must be at least 16 years old (or the age of majority in your jurisdiction, whichever is greater) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Description of Service
Engineer Exams provides AI-generated, scenario-based practice exams for IT certifications. The Service includes:
- Practice exams for Microsoft, AWS, CompTIA, Google Cloud, and ISC² certifications
- Domain-level performance tracking and insights
- Exam history and progress analytics
- Free tier with limited access (1 exam per certification)
- Paid tier with full access to all exams
Important Disclaimer: Engineer Exams is an independent study resource and is not affiliated with, endorsed by, or sponsored by Microsoft, Amazon Web Services, CompTIA, Google, ISC², or any certification vendor. Our practice exams are designed to help you prepare but do not guarantee certification success.
4. Account Registration
4.1 Account Creation
To access paid features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your password
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to maintain account security.
5. Subscription and Payment
5.1 Free Tier
We offer limited free access (one practice exam per certification) without account registration. Free tier does not include domain-level insights or exam history.
5.2 Paid Subscription
Paid subscriptions provide full access to all practice exams, domain insights, and performance tracking. Subscription pricing is displayed on our website and varies by region.
5.3 Billing
- Recurring Charges: Subscriptions are billed monthly on a recurring basis until cancelled
- Payment Processing: All payments are processed securely by Stripe
- Currency: Prices are displayed in USD or local currency based on your region
- Authorization: By subscribing, you authorize us to charge your payment method
- Failed Payments: If a payment fails, we may retry charging and/or suspend your access
5.4 Price Changes
We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current billing cycle but will apply to subsequent renewals.
5.5 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds for partial months.
5.6 Refund Policy
We offer a 7-day money-back guarantee for first-time subscribers. After 7 days, subscriptions are non-refundable. Refunds for exceptional circumstances are at our sole discretion.
6. Acceptable Use Policy
You agree NOT to:
- Share your account credentials with others
- Use the Service for any illegal or unauthorized purpose
- Copy, distribute, or resell our practice exam questions
- Scrape, crawl, or use automated tools to extract content
- Reverse engineer or attempt to extract source code
- Circumvent any security features or access controls
- Upload malware, viruses, or malicious code
- Impersonate another person or entity
- Harass, threaten, or abuse other users or our staff
- Use the Service to train competing AI models or create derivative works
- Submit false or fraudulent information
- Violate any applicable laws or regulations
7. Intellectual Property Rights
7.1 Our Content
All content on the Service, including practice questions, explanations, domain frameworks, software, design, graphics, logos, and trademarks, are owned by Engineer Exams or our licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only. This license does not include:
- Downloading or copying content (except as necessary for normal browser caching)
- Redistribution or commercial use
- Modification or derivative works
- Use of content for training AI models
7.3 Trademarks
"Engineer Exams" and our logo are trademarks of our company. Microsoft, Azure, AWS, CompTIA, Google Cloud, ISC², and other certification names and logos are trademarks of their respective owners. Our use of these marks is for identification purposes only and does not imply endorsement.
8. User-Generated Content
If we enable features that allow you to submit content (feedback, comments, support messages), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content for operating and improving the Service.
You represent that any content you submit does not violate third-party rights or applicable laws.
9. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.
10. Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We specifically disclaim any warranties that:
- The Service will be uninterrupted, secure, or error-free
- Practice exams will result in certification success
- Content is accurate, complete, or up-to-date
- Defects will be corrected
- The Service is free from viruses or harmful components
No Guarantee of Results: Engineer Exams is a study tool. Your certification success depends on many factors beyond our control. We do not guarantee you will pass any certification exam.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- This includes lost profits, lost revenue, lost data, or business interruption
- Our total liability is limited to the amount you paid us in the 12 months before the claim
- If you have not paid us, our liability is limited to $100 USD
These limitations apply even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain liability exclusions, so these limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Engineer Exams, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit
13. Termination
13.1 By You
You may terminate your account at any time by cancelling your subscription and deleting your account through account settings.
13.2 By Us
We may suspend or terminate your access immediately, without notice, if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Abuse the Service or our staff
- Fail to pay subscription fees
13.3 Effect of Termination
Upon termination, your right to access the Service ceases immediately. All provisions that should reasonably survive termination (including payment obligations, disclaimers, liability limitations, and dispute resolution) will continue to apply.
14. Changes to Service and Terms

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. We are not liable for any modification, suspension, or discontinuation.
14.2 Terms Changes
We may update these Terms from time to time. Material changes will be communicated via:

- Updating the "Last Updated" date
- Email notification for significant changes
Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
15. Third-Party Links and Services
The Service may contain links to third-party websites (certification vendors, payment processors, etc.). We do not control these sites and are not responsible for their content, privacy practices, or terms.
Your interactions with third parties are solely between you and them. We encourage you to review their terms and policies.
16. Dispute Resolution and Arbitration
IMPORTANT: This section contains an arbitration agreement and class action waiver. It affects your legal rights.
16.1 Informal Resolution
Before filing a claim, you agree to contact us at legal@engineerexams.com to attempt informal resolution. We will attempt to resolve disputes within 30 days.
16.2 Arbitration Agreement (US Users)
For users in the United States: Any dispute arising from these Terms or the Service shall be resolved through binding arbitration under the American Arbitration Association (AAA) rules, rather than in court.
- Arbitration is conducted remotely or in your county of residence
- Arbitrator's decision is final and binding
- Each party bears their own costs unless otherwise required by law
- Small claims court jurisdiction is preserved for qualifying claims
16.3 Class Action Waiver
You agree to resolve disputes individually, not as part of a class action, consolidated proceeding, or representative action. There is no right or authority for any dispute to be arbitrated on a class basis.
16.4 International Users
For users outside the United States, disputes are subject to the exclusive jurisdiction of courts in your country of residence, subject to mandatory consumer protection laws.
17. Governing Law
These Terms are governed by:
- US Users: Laws of Delaware, United States (excluding conflict of law principles)
- EU Users: Local consumer protection laws and GDPR requirements prevail
- Other International Users: Local laws and mandatory consumer protections apply
Nothing in these Terms limits your mandatory consumer rights under local law.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Engineer Exams regarding the Service and supersede all prior agreements and understandings.

By using Engineer Exams, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
